Divorce between wife and husband in Nepal: What does Civil Code 2018 say?



The new Civil Code was introduced in Nepal in August 2018 repelling earlier Country Code that was introduced in 1963/64.

The provision related to getting divorce provided under Chapter 3 of "Provisions related to Divorce". There are specific provisions which has allowed both wife as well as husband initiate to divorce (Clause 93).


When does a husband initiate a divorce?


The following conditions are set forth by the law (Clause 94):


  • If the wife stays away from the husband for a consecutive Three (3) years or more without consent. 
  • If the wife forces/banishes the husband by not providing adequate food or clothing. This was much applicable in the case of wife only in previous law. 
  • If the wife commits and or conspires to commit any incidents that results to the deformity in the physical organs or mental suffering of the husband. 
  • If the wife is proven to have established sexual relationship with others. 

When does a wife initiate a divorce?


The following conditions are set forth by the law (Clause 95):


  • If the husband stays away from the wife for a consecutive Three (3) years or more without consent. 
  • If the husband forces/banishes the wife by not providing adequate food or clothing. 
  • If the husband commits and or conspires to commit any incidents that results to the deformity in the physical organs or mental suffering of the wife. 
  • If the husband conducts a next marriage
  • If the husband is proven to have established sexual relationship with others. 
  • If the husband is proven to have raped the wife. 

How do either party initiate?

Either parties that wants to initiate divorce should file a petition before the Court of law. (Clause 96)

Author's Impression towards the newer provisions

The author has following impressions: 
1. The new provisions have ensured an equal scope for both husband and wife initiate divorce. The earlier laws were not generous in allowing husbands initiate the divorce. 

2. In earlier setup, if a husband wanted to initiate divorce, he was supposed to go through various formalities prior to reaching the court i.e. discouraging husbands to initiate. But the change in the law has defined court as the place for both to reach. 

3. The new law is still rigid in terms of considering wife dependent with the husband. In terms of husband providing money for subsistence, the earlier provisions are continued where the wife, if initiates the divorce, a certain amount of husband's earning goes to the living of the wife.

  3. The petition can be filed without the presence of husband. The divorce is initiated from the court hence reaching before the competent court is necessary.

    1. The issues related to divorce is concerned with the incidents that took place only after marriage. To your query, a divorce cannot be initiated.

    1. Marriage not registered (formally) might be supported by other evidences such as ceremony if taken place or even photographs or witnesses. And, separated for more than 3 or more consecutive years without consent is required to initiate the proceeding.

    1. With the information that you provided, it does not seem that the divorce took place in between the husband and wife after the wife (alleged) stayed away for more than 3 years without consent. In my opinion, the act of divorce should had been initiated instead of assuming that being separated for more than 3 years results into divorce automatically.

      Also, it is a bit unclear what the husband want to achieve out of the incidence where the first wife came and took the child away. Does he want to keep the child with him?

    1. Yes, the women who the man is said to have married at the first place can claim on her husband places. The following things should be made sure:
      a. No divorce took place between the husband and his first wife
      b. There are evidence that they are married or have children
      c. The said first wife did not remarry with or without consent.

  12. My wife always fight over small issues. Generally because of mother-in -law and other unproven hypothetical matter. And now she starts asking for divorce. I believe this is because due to she wants property. So if she files divorce will she get divorce ? How much share she will take ? Property is still is not in my name it is in my parents name.     1. As provided, The following conditions (either) should be established in order to initiate divorce. :
      1. If the husband stays away from the wife for a consecutive Three (3) years or more without consent.
      2. If the husband forces/banishes the wife by not providing adequate food or clothing.

      4. If the husband conducts a next marriage

      5. If the husband is proven to have raped the wife.

      If the divorce takes place, the wife is entitled to receive equal part of the property that comes under your title. Means, if you have a total of 1 ropani of land either inherited from your parents or your mutual earning, the wife is entitled to receive half a ropani of land. If you have a child, the 1 ropani land is shared into three equal parts.

      Regarding the earning, the wife, before the court might plead for subsistence money till the case is concluded. But it depends if the wife is willing to claim such an amount. But, if the wife has been earning more than the husband does, no such claim can be initiated.

    1. There is no such instance where divorce take place automatically. Based on your explanation, you can mutually agree with your husband to initiate divorce. Secondly, either the party can initiate divorce procedure establishing that either of you have been separated for more than 3 years without consent.

    1. If I understood correctly, you have already had the property separated but did not initiate the divorce process. Yes, the husband, with a clear establishment of the fact that the wife has been staying away for more than three years without his consent can initiate the divorce process.

    Here my concern is that we are in Australia and we live separately. But our marriage is register in Nepal only in municipality. Now we want divorce. Is it possible to get divorce. As we don't mention any documents in Australia that we are married.

    2. To initiate divorce, there should be either i) consent from both the husband and the wife or ii) reasons backed by evidence that I have stated in the blog. To answer your question, divorce cannot be initiated without valid grounds. Right in husband's wealth, yes it is applicable if only the wife wants to claim over her husband's property. However, if the husband initiates the divorce proceedings with charges b, c and d of Section 94, then there is no ground for claiming over husband's property.

    A Nepali couple married twice - once in Nepal and once in Japan. The couple then divorced in Japan. They are still living in Japan separately. Are they still married in Nepal?
